WORKPLACE HARASSMENT

It’s unlawful to harass an employee under both Federal and Louisiana state law of any protected class, whether it’s on the basis of gender, age, race, religion, etc.  Sexual harassment is most commonly thought of and can occur via requests that a person involve certain sexual acts in order to receive a benefit or promotion or just through inappropriate comments and gestures.  An employee doesn’t even have to be the target of the improper comments and gestures to have a legal claim.  ​

EMPLOYMENT DISCRIMINATION

Federal law prohibits employers from discriminating against potential employees on the basis of race, gender, religion, national origin, age, disability or status as a protected veteran.  An employer refusing to promote or compensate an employee as much as his/her similarly situated peers on the basis of any of those reasons is also a form of discrimination.

UNFAIR PAY

Federal minimum wage is $7.25 per hour for covered, nonexempt employees. Certain exceptions apply, such as commission based employers or employers who receive tips, provided that the tips and salary total the minimum wage.  Under federal law, all covered, nonexempt employees are entitled to overtime at the rate of 1.5 times their normal salary when working in excess of 40 hours per week.
